さらにアホなEULAについて

前回取り上げたAppleのケースが引き金になってか、アホなEULA探しが海外(のごく一部)で盛り上がっている。今回Ars Technicaが見つけたのはAdobeのケース。

今週、AdobeがSaaS版のPhotoshop、Photoshop Expressを運用開始して話題になった。その利用規約(3月1日版)には、以下のような文面が含まれている。

8. Use of Your Content.
1. Adobe does not claim ownership of Your Content. However, with respect to Your Content that you submit or make available for inclusion on publicly accessible areas of the Services, you grant Adobe a worldwide, royalty-free, nonexclusive, perpetual, irrevocable, and fully sublicensable license to use, distribute, derive revenue or other remuneration from, reproduce, modify, adapt, publish, translate, publicly perform and publicly display such Content (in whole or in part) and to incorporate such Content into other Materials or works in any format or medium now known or later developed.(強調は引用者)

ようするに、Photoshop Expressで編集すべく自分の写真なり画像なりをアップロードすると、自動的にその画像についてAdobeに配布から販売から何からほとんどあらゆる権利を認めることになるという、ものすごい条項が含まれていたのである。

日本でもつい最近、Mixiが似たような利用規約にしようとして騒ぎになっていた。洋の東西を問わず、この手の条項を入れるというのがある種のライセンスを書く人の常識なのだろうか?

まあ実際問題としては、AdobeなりMixiなりがこうした条項をタテにユーザのコンテンツを流用するというのが、ユーザの支持をいっぺんに失うリスクに見合うほどのプラスをもたらすものでありうるかと言えば微妙だろうが、いずれにせよ気分の良くない話である。なお、Adobeは早急な改訂を約束しているそうだが、執筆時点ではこの条項はまだ入っていた。
